Employers with workers such as sales representatives, who do not have a fixed office, need to be very careful to ensure that they are complying with working time regulations.
A recent ruling by the European Court of Justice means that the time a worker spends travelling between home and the day’s first appointment, and then back from the day’s final appointment, should count as working time. The basic rule is that a worker must not work more than 48 hours a week on average.
However, the ruling does not change entitlement to the national minimum wage because this is purely a UK right.
